This website, www.nanobits.org, is to inform people about nanotechnology products and services and make some available for convenient retail purchase regardless of the purchasers time or place. These terms make it clear for both NGS and the purchaser to understand what is expected of each other when using this website. By using this website you agree to be bound by the following terms. Please read them carefully. By using the website and/or placing an order on the website indicates your acceptance of these terms and conditions.
All information supplied has no warranty and is not intended to be nanotechnology advice either directly or by implication. Information provided is general in nature. This clause also applies to product packaging or labels.
All content on this website is Copyright 2008 with ALL RIGHTS RESERVED. You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose. Any unauthorized or misuse of the materials appearing on this site could result in criminal or civil penalties.

You agree to indemnify and hold NGS Director, officers and associates harmless from any claim or demand including reasonable legal fees made by you are any third party due to or arising out of content you submit, post or transmit through the site, your connection to the site, your use of the site, your violation of the Terms of Use, or your violation of the any rights of another.
NGS retains the right to refuse any and all current and future use of the site, particularly where reasonable evidence of misuse becomes known to NGS.
Payment and Delivery
Credit Cards and Delivery (Visa, Mastercard & Bankcard).
Be sure to provide your exact billing address and telephone number – the address and phone number your credit card bank has on file for you. Incorrect information may cause a delay in processing your order. Billing occurs when the order is placed in advance of delivery which can generally be a few days but to the possibility of weeks, depending on contractors and suppliers for example. Shipping charges are not included in the pricing of individual items and are displayed separately either at checkout or through NGS communication after placement of order. Any import duties, customs duties or restrictions incurred by international customers are the responsibility of the customer and are beyond the control of NGS.
International customers are advised to check with the relevant authorities in their country before placing an order.
All cheques and money orders plus EFT Cheques and money orders are accepted in $AUD but up to 10 days needs to be allowed for funds to be cleared at which time the order will be processed. It is possible goods may no longer be available at that time.
$AUD25 fee will be charged on all returned cheques.
Cheques / orders should be made payable to Nano Goods and Services and posted with a copy of your order to Nano Goods and Services, PO Box 132, Nar Nar Goon, Victoria 3812.
Electronic Funds Transfer payments can be made following placement of order notifying this as the preferred mode of payment whereupon you will be advised of banking details in order to complete your order. Order processing will not commence until funds are cleared 5 banking days later.
GST
All NGS products are GST inclusive which means they include the Australian Goods and Services tax charged under A New Tax System (Goods and Services Tax) Act 1999 (the "Act"). A Tax invoice means a tax invoice as defined by the Act.
Risk of Loss
All items purchased form NGS are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon NGS delivery to the carrier.
Order Acceptance
Your receipt of an order confirmation does not signify NGS' acceptance of your order not does it constitute confirmation of our offer to sell. NGS reserves the right to accept or decline your order for any reason at any time. NGS also reserves the right to supply a lesser quantity than what was ordered. NGS may also require additional verifications or information before accepting any order.
Returns & Procedures
NGS are happy to refund all or some of the purchase price of any product under the following conditions:
Goods can only be returned under a Return Authorisation Number (RAN) and shipping address advice which can be obtained by contacting NGS within 7 days of receiving the goods. Products must be in the original undamaged packaging and returned within 14 days of purchase. The goods need to be accompanied with the RAN, original receipt and instructions to be processed eg. Return or exchange. No responsibility will be taken for goods without an RAN sent to the wrong address.
Goods that are deemed by NGS to not be in good order and condition may attract a restocking fee up to 15%, a replacement cost or refuse the return in its entirety.
Faulty products can be either exchanged or refunded through the customer's credit card according to their instructions. Fault, if any, will be judged solely by NGS.
Shipping charges will not be refunded and exchange costs are borne by the customer. NGS reserves the right to return goods to the customer at the customer's expense.
Errors and Omissions
NGS and its associates attempt to be as accurate as possible however they do not warrant the product descriptions or other content of this site as to be accurate, complete, reliable, current, or error free. If you feel a product is not as described, your sole remedy is to return it in an unused condition consistent with our Returns and Procedures policy. If your credit card has been charged incorrectly NGS will issue a credit to your credit card account to the amount of the incorrect price eg. If incorrect pricing on site.
Applicable Law
As far as legally possible this Agreement, you agree to submit to the laws of the State of Victoria and to have any matter associated with this website dealt with in a court located in Melbourne, Victoria, Australia.
Termination
These terms are effective even if this Agreement is terminated by either party. NGS reserves the right to suspend or deny, in its sole discretion, your access to any and all of the site, without notice. You agree that termination will result in the removal of all registration information file and therefore access to such files or the site. You also agree NGS will not be liable to you or any third party for any termination of access to the site.
General
These Terms and Conditions constitute the entire Agreement between NGS and you and govern the use of the site. You may also be subject to other terms and conditions that may apply from affiliated services or third parties to the site. If NGS fails to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
Shipping Information
For Australian Orders
All orders for Australian customers are dispatched using (tba) system. This provides tracking information for your parcel and also requires a signature on delivery.
Shipping charges are determined by the total weight of your order. Please refer to the following for the applicable shipping rates:
Orders weighing 0 - 1kg: $4.95 per order to anywhere in Australia. (tbc)
Orders weighing 1kg - 3kg: $8.00 per order to anywhere in Australia (tbc).
Orders weighing over 3kg are charged at a flat rate of $8.00 per order, plus a per kilogram rate of $1.00 per kilogram (tbc)
Local Area orders pay a minimum of $4.95 for orders up to 1kg and a maxiumum of $8.00 for orders over 1kg. (tbc) Local Area is defined as shipping addresses located within the following Australian postcodes: 4000-4224; 4226-4299; 4500-4549. Please do not select this method unless you are located within these postcodes as your order will not be shipped until all additional postage charges are paid.
Product shipping weights are included in the item description for all products listed on…(tba) . The listed shipping weight is the shipping weight that will be used to calculate your final shipping total. The listed shipping weight includes the net weight of the product and any associated packing material.

Shipping Information for International Orders.
Three alternative shipping methods are available for international customers.
Regular Airmail (Uninsured), Regular Airmail (Insured) and Express Courier International. Airmail has an average delivery time of 7-10 working days ( not including weekend days and public holidays) but can be longer to some destinations.
Express Courier International has an average delivery time of 3-5 working days depending on destination.
Shipping charges are as follows:
Airmail (Uninsured): $8.50 per order, plus $20 per kilogram.(tbc)
Airmail (Insured): $13.50 per order, plus $20 per kilogram.(tbc)
Express Courier International (Insured): $35.00 per order, plus $20 per kilogram.(tbc)
